Allgemeine Geschäftsbedingungen zur Teilnahme an einer Informationsveranstaltungsreihe („exo-one“) des innovationagency network („IACy“)
1. Veranstalter ist, sofern im Einzelfall nichts anderes ausdrücklich vereinbart ist, IACy International FZCO – Nikolaus Skene, Dubai Airport Free Zone Building 9W Block C Office 523 - 68 9WC 523
2. Anmeldungen finden über die Website "Plans & Pricing" statt.
3. IACy behält sich das Recht vor, eine Veranstaltung bei Verhinderung des Seminarleiters oder wegen mangelnder Teilnehmerzahl abzusagen bzw zu verschieben. In diesen Fällen werden wir Sie über Absagen bzw. erforderliche Änderungen des Programms nach Möglichkeit schriftlich per e-mail, notfalls auch telefonisch oder in sonstiger Form verständigen. Grundlage für die Verständigung über eine Absage sind die bei der Anmeldung angegebenen Daten.
4. Der Veranstalter behält sich (auch kurzfristige) Änderungen des Programmes vor. Änderungen bei den Sprechern bzw Referenten sind möglich. IACy wird sich jedoch bemühen, die ursprünglich vorgesehenen Referenten bzw Veranstaltungen im Bedarfsfall durch andere hinsichtlich des angekündigten Themas ebenso qualifizierte Person bzw eine gleichwertige Veranstaltung zu ersetzen. Weitergehende Ansprüche sind ausgeschlossen.
5. Der Veranstalter sowie dessen Referent(en) sind jederzeit berechtigt, Personen, welche die persönliche Sicherheit von Veranstalter, Besuchern, Referenten gefährden oder die Erreichung des Lernzieles bzw. den Ablauf der Veranstaltung gefährden/stören, von einer weiteren Teilnahme ausschließen. Eine Rückerstattung von Teilnahmebeiträgen ist in solchen Fällen zur Gänze ausgeschlossen. Die Entscheidung, ob der verwiesene Teilnehmer zu einem späteren Zeitpunkt nochmals an einer Veranstaltung teilnehmen kann, obliegt allein dem Veranstalter.
6. Die Teilnahme an einer Veranstaltung erfolgt auf eigene Verantwortung. Mit der Anmeldung erklären Sie, dass Sie im Vollbesitz Ihrer geistigen Kräfte sind und für Ihre physische sowie psychische Gesundheit und Sicherheit eigenständig sorgen können. Der Veranstalter haftet im Falle einer "Offline" Veranstaltung nicht für Verluste oder die Beschädigung von mitgebrachten Kleidern und Gegenständen auf Veranstaltungen sowie auch nicht für allfällige Personen- und sonstige Sachschäden! Aus der Anwendung der erworbenen Kenntnisse und Fähigkeiten können keine wie immer gearteten Gewährleistungs- oder Haftungsansprüche gegenüber dem Referenten sowie den Veranstalter gemacht werden. Im Falle einer allfälligen Haftung ist diese mit dem Teilnahmebeitrag netto pro Person begrenzt. Die Beweislastumkehr, also die Verpflichtung des Veranstalters die Unschuld an einem Mangel oder Schaden zu beweisen, ist ausgeschlossen. Sofern nicht einvernehmlich und explizit schriftlich anders vereinbart, übernimmt der Veranstalter keinerlei Haftung für Mangelfolgeschäden, entgangenen Gewinn sowie allenfalls fehlgeschlagene Anwendung oder Umsetzung aus einer Veranstaltung. Darüber hinaus wird die Haftung für leichte und grobe Fahrlässigkeit ausgeschlossen. Keinesfalls übernimmt der Veranstalterin irgendeiner Form eine Erfolgsgarantie bzw. eine Erfolgshaftung. Sie werden aufgefordert, auf Fragen bezüglich Ihrer Gesundheit vor Veranstaltungsbeginn anzugeben, ob körperliche Schwierigkeiten vorliegen und bei der Praktizierung von Übungen/Teilnahme an Veranstaltungen mit körperlicher Aktivität Probleme auftreten können.
7. Die uns überlassenen Daten werden mittels elektronischer Datenverarbeitung unter Beachtung des Datenschutzrechtes verarbeitet und gespeichert. Eine Weitergabe von Daten an Dritte erfolgt nicht. Soweit vom Vertragspartner nicht anders angegeben, darf der Veranstalter diese Daten für eigene Informations- und Werbezwecke verwenden.
8. Für das Vertragsverhältnis gilt materielles österreichisches Recht bzw das jenes Landes, in dem wir als Veranstalter auftreten. Für Verbraucher nach Konsumentenschutzgesetz gelten die entsprechenden zwingenden Verbraucherschutzbestimmungen, Sämtliche personenbezogenen Bezeichnungen gelten für beiderlei Geschlecht. Erfüllungsort sowie Gerichtsstand für alle aus diesem Vertragsverhältnis entstehenden Ansprüche sowie allfällige Rechtsstreitigkeiten ist ausschließlich der Sitz des Veranstalters in Dubai, United Arab Emirates.
General Terms and Conditions for Participation in a Series of Information Events („Silicon Valley Inspiration Tour“) by the innovationagency network („IACy“)
1. Organizer, unless specifically indicated otherwise, shall be IACy International FZCO – Dubai Airport Free Zone Building 9W Block C Office 523 - 68 9WC 523, Dubai, United Arab Emirates.

3. A subscription does not entitle the subscriber to a right of regular inspiration (talks or other programs) IACy reserves the right, to cancel, respectively, postpone, an program in case of inability or indisposition of the event-host or because of insufficient participant numbers. In such an event you will be notified of cancellation or event modifications in writing via e-mail or, as the case may be, via telephone or in other form. The basis for such communication shall be the data submitted by you in the course of your application.
4. The Organizer reserves the right to make alterations (even and also on short notice) to the originally announced event program, including, without limitation, events, event venues, event dates, speakers, contributors, etc. IACy will nevertheless seek to replace events, speakers, contributors, etc, with persons or events of equal value with respect to the topic as the originally intended ones. Any and all claims over and beyond this, in particular, but without limitation, claims for compensation for damages, shall be explicitly excluded.
5. The Organizer and his agents are entitled at all times to exclude and/or expel Participants endangering personal security of the Organizer, his agents, speakers, contributors, or participants, or the learning success of the latter, respectively, disrupt an event. In any such case, a refund of Participation Fees is explicity excluded. It lies in Organizer’s sole discretion, whether the expelled Participant may take part in another event at a later Point in time.
6. Participation in an event is at Participant’s own risk. With your application you declare to be of sufficient mental capacity and able to take care of your physical and mental health independently. Organizer shall not be liable for loss and/or damage of clothes, valuables and othe objects brought along by the Participant to an event. Organizer shall further not be liable for any personal injury and/or damage to property and/or consequential damages. No guarantee or liability claims against the Organizer, his agents, speakers, and contributors shall arise from the application of the knowledge and/or skills acquired through participation in the event. However, any liablity shall be limited to the net amount of the equivalent of one month subscription. Any reversal of the burden of proof, i.e., Organizer’s obligation to prove his innocence with respect to any alleged fault or damage, shall be explicitly excluded. Unless otherwise agreed to explicitly and in writing, Organizer shall not be liable for any consequential damages, lost profits, or, as applicable, failed or unsuccesful implementation of information or skills obtained from an event. Further, Organizer’s and his agents‘, speakers‘ and contributors‘ liability for (slight and gross) negligence is expressly excluded. By no means the Organizer untertakes any form of guarantee of success or liabilty for success. You are advised to disclose on our asking any issues regarding your health and to indicate if any problems may arise in connection with carrying out physical exercises or the participation in events with physical activity.
7. The personal data provided by you will be recorded and processed by means of electronic data processing under observation of the Austrian Data Protection Act. No transfer of data to third parties shall be made. Unless otherwise indicated by our contractual partner, Organizer shall be entitled to use the data for information and advertising purposes.
8. The contractual relationship shall be subject to substantial Californian law, respectively, the law of the country, in which we act as Organizer. For consumers as defined by the Austrian Consumer Protection Act the respective mandatory provisons shall be applicable. Any personal terms put down herein in their male form only shall refer to women and men equally. Place of performance and legal venue for any and all claims and/or legal disputes arising from the business realtionship governed hereunder shall be Organizer’s legal domicile in Dubai, United Arab Emirates.
